Types of employment
The types of employment that are possible are regulated in the Employment Protection Act (lagen om anställningsskydd – LAS). There are two types of employment: permanent and fixed-term.
Permanent employment
Permanent employment is work that lasts for an indefinite period of time until it is terminated by the employee or employer. The main principle in LAS is that employment should be permanent in order for the employee to have better job security.
Fixed-term employment
Fixed-term employment is work that lasts for a limited period of time. The employment cannot be terminated prematurely but ceases automatically at the end of the contract period. If the worker has been employed for a total of more than 12 months (substitutes), total of more than nine months (special fixed-term employment) during the last three years, written notification must be given to the worker no later than one month before the termination of employment. Fixed-term employment can be used for:
- Special fixed-term employment
- Substitutes
- Employees over the age of 68
Special fixed-term employment
This type of fixed-term employment can be used for staffing a project or bringing in help to manage a temporary increase in workload, etc. The employment ceases automatically at the end of the contract and cannot be terminated prematurely. If the total length of time in employment amounts to one year over a five-year period, it is automatically converted to permanent employment.
Substitutes
This is a form of fixed-term employment that can be used to replace a worker who is absent due to parental leave, illness, holiday, leave of absence etc. It can also be used to fill an empty position during the time it takes to recruit someone for that position. A substitute automatically becomes a permanent employee if the person has been employed for a total of two years over a five-year period.
Employees over the age of 68
Fixed-term employment may be used for individuals who are over the age of 68, regardless of the nature of the work and the length of employment.
