The research exception
When procuring research and development services, the Swedish Public Procurement Act (LOU 2016:1145) applies. Only in cases where an external party funds the research and development services, it is possible to go outside the LOU. Please note! The research exemption does not apply to EU-funded funds.
The Swedish Public Procurement Act (LOU 2016:1145) applies to the procurement of research and development services in the following areas:
- experimental development
- research and development services and related consulting services
- planning and implementation of research and development
- testing and evaluation
- preparatory feasibility study and technical demonstration
As a rule, it is the Swedish Public Procurement Act that applies when we as a contracting authority:
- Owns the results of the research and development services
- Funding the service provided
However, research and development services financed by an external party are not covered by the Swedish Public Procurement Act and the research exception can then be invoked.
Please note! The research exception does not apply to EU-funded funds. Then a procurement must be carried out. Therefore, always check what the financier requires to pay out the aid!
