Right of priority for additional working hours
Those employed on a less than full-time basis have the possibility of requesting an increase in working hours.
Right of priority for additional working hours applies to both those employed on an ongoing basis as well as those on a fixed-term contract, and applies only when a need for additional manpower arises at the place of work in which you are located.
Right of priority in this case presupposes that:
- the employer's need for extra manpower will be met by the employee being given additional working hours.
- the part-time employee is sufficiently qualified for the new duties.
- the part-time employee has registered a request for additional working hours.
Employees with a long length of service are prioritised over those with a shorter length of service. If the lengths of service are equal, higher age is prioritised.
For employees under a fixed-term contract, the additional working hours cannot cover a longer period of time than the fixed-term position.
An offer for additional working hours takes precedence over a right of priority for re-employment according to Section 25a of the Employment Protection Act.
